Terms of Service

These Terms govern your use of the PrizmBet mobile application and website, operated by Prizm Bet, Inc. (“PrizmBet,” “we,” “us”). By creating an account or using PrizmBet, you agree to these Terms. If you do not agree, do not use PrizmBet.

1. What PrizmBet is — and what it is not

PrizmBet is a sports analytics and decision-support tool. It quantifies factors that affect the likelihood of sporting outcomes and presents them as confidence scores and factor insights.

2. No guarantee of outcomes

Sports outcomes are inherently uncertain. We do not guarantee the accuracy of any projection, confidence score, factor insight or other output.

• A confidence score is a statistical estimate, not a prediction of fact, and not a promise.
• Past performance does not predict future results. Any historical accuracy or return figure we publish describes a specific past sample over a stated period. It is not a forecast, and it is not a representation of what you will experience.
• Our models change over time. Figures published at one date may not describe the model in use at a later date.
• Data comes from third-party providers and may be delayed, incomplete or incorrect.

You should not rely on PrizmBet as your sole basis for any financial decision.

3. Eligibility

You may use PrizmBet only if you are at least 18 years old (or the age of majority where you live, if higher) and are legally permitted to use a sports analytics service in your jurisdiction.

Gambling laws differ by country, state and territory. You are solely responsible for knowing and complying with the laws that apply to you. We make no representation that PrizmBet, or any activity you undertake using it, is lawful where you are.

4. Your responsibility for wagering decisions

If you choose to place wagers with a third-party operator, you do so entirely at your own risk and expense. To the fullest extent permitted by law:

• We accept no liability for any loss, financial or otherwise, arising from any wager you place, whether or not it was informed by PrizmBet content.
• We are not responsible for the conduct, solvency, terms or availability of any sportsbook or operator you use.
• We do not verify that any wager you place is lawful in your jurisdiction.

5. Your account

You are responsible for keeping your credentials confidential and for all activity under your account. Tell us promptly at support@prizm.bet if you believe your account has been compromised.

You may delete your account at any time in the app (Account → Delete Account), or see prizm.bet/delete-account. We may suspend or terminate accounts that breach these Terms, and we may discontinue the service or any feature at any time.

6. Acceptable use

You agree not to:

• scrape, crawl, harvest or systematically extract data from PrizmBet;
• reverse engineer, decompile or attempt to derive our models, weights or methodology;
• resell, redistribute, sublicense or publish PrizmBet outputs as your own product or tipping service;
• access the service by automated means except as we expressly permit;
• interfere with, overload or attempt to gain unauthorized access to our systems;
• use PrizmBet for any unlawful purpose.

7. Intellectual property

PrizmBet, including its models, factor definitions, confidence methodology, software, content and branding, is owned by Prizm Bet, Inc. and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use. No other rights are granted.

Underlying sports data is owned by our data providers and licensed to us. Team and league names are the property of their respective owners; we are not affiliated with, endorsed by, or sponsored by any team, league or governing body.

8. Subscriptions and payments

PrizmBet sells access to analysis through the Apple App Store. Billing is handled entirely by Apple — we never see or store your payment details.

What is sold

Renewal and cancellation

Payment is charged to your Apple Account at confirmation of purchase. A Sport Pass renews automatically at $9.99 per month unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period. You can manage or cancel a subscription at any time in your Apple Account settings.

A Day Pass is a one-time purchase. It expires 24 hours after purchase and does not renew.

Refunds

Refunds for App Store purchases are handled by Apple under its own terms, not by us. Request one at reportaproblem.apple.com. We cannot issue App Store refunds directly, but if something has gone wrong write to support@prizm.bet and we will help where we can.

Complimentary and trial access

Some accounts hold access we granted rather than sold — founding testers, trials and complimentary passes. These carry an expiry date, are not charged for, do not renew, and may be withdrawn at any time.

9. Disclaimer of warranties

PrizmBet is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that any output will be accurate or reliable.

10. Limitation of liability

To the fullest extent permitted by law, Prizm Bet, Inc. and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or gambling losses, arising from or relating to your use of PrizmBet — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility.

Our total aggregate liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty US dollars (US$50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless Prizm Bet, Inc. from any claim, loss, liability or expense (including reasonable legal fees) arising from your use of PrizmBet, your breach of these Terms, or your violation of any law or third-party right.

12. Changes to these Terms

We may update these Terms. If a change materially affects your rights we will notify you in the app or by email before it takes effect. Continuing to use PrizmBet after a change takes effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or your use of PrizmBet will be brought exclusively in the state or federal courts located in the State of Delaware, and you and we each consent to the personal jurisdiction of those courts.
